"She walked in the door and just managed to press the alarm when her husband came running in and started beating her with a hammer, the 10 year old daughter was so afraid that she runned and hide when she saw the man came running, he beat her with the hammer and started choke her but the womans dog saved her when it started to bite the husband" - Norweigan News

Wait till you come to Holland, 5 years for a murder is no exception here, seriously.

well it's all comes down to the question: punishment or correctional treatment. If it's supposed to be punishment 5 month is a joke.. if it's supposed to be correctional treatment maybe 5 month of treatment *may* be valid. If it's supposed to be a little bit of both 5 month is a joke to..

I remember quite some time ago in Australia I was in court as a witness and the court case before mine was still going when I arrived. A father and son were being charged for nailing their wife/mother to the dining table by the tounge and then setting the room on fire. She somehow managed ti survive.
The son got 3 years probation and the father was less than 3 years.
I was only a young bloke at the time and remember at how replused I was, and shocked at the lack of any real punishment handed out....really shaken by it actually.
Sounds like Oz is not the only place completely rooted like this.

well, you can get sentenced to life right KickYourHeadOff? Atleast we've got life sentence in sweden and our sentence system is much the same as yours..
/Btw, I study Law and earlier I studied criminology. Prison (or death sentence) is not the answer :)

I study law as well, what is your solution then?
Woops, too slow

I dont have _the_ solution. But something that has to do with better living standards, lesser poverty, more equality etc would be preferred. There is no coincidence that the absolut majority of prison inhabitants come from a similar background
and ofcourse treatment for those that commit crimes anyhow to ensure a better future for them but also for the community at whole
Not that it will ever happen, afterall, the prison industry is a multibillion $ a year industry that is expandning at a tremendous rate. They throw huge amounts of cash to the lobby groups fighting for longer sentences and a harsher prison system. Btw, an interesting read about the prison industry is "Crime control as industry" by norweigan professor in criminology "Nils Christie"

I`m really having trouble deciding if I`m ok with capital punishment or not. Like if someone killed my family or whatever, I really wouldn`t give a shit about correctional treatment. But on the other hand, killing the bastard wouldn`t bring back anyone.

Yup against it as a principle but if it happened to someone I knew I am all for fullscale retaliation. But thats the individual view, the law should concern itself with the stopping/removing of crime and protection of the lawful society, not eye for an eye revenge (imho)

And looking at it from smaller crimes, I think it's terrible that after f.e. a rape, the perpetrator is the one ending up receiving psychological therapy so he can be "cured" and "re-adapted to society". Who helps the victim get back to real life? Look at murders, too, and the fines they issue on behalf of the families. Those, along with the sentences for rapes, assaults, and so on, is a slap in the face of the victim and/or their loved ones. It's messed up on so many levels.

Well, I'm not sure about other countires but in Britain rape victims are all offered and heavily encouraged to have counselling. And that support continues for quite some time. It happens for other crimes too. not saying the system is great but at least help is made available.
Do agree with everything else you said though.

I should dig up the old newspaper reports, but I`m too lazy....
Anyway, in Japan we had some guy that kidnapped a girl of about 10 years, and kept her as his...well, slave...sexually and otherwise for something like 11 or 12 years.....with his mother living downstairs in he same house.
Anyway, the shit hit the fan and he got busted. The girl couldn`t even walk as her muscles had wasted away from being locked to the bed and beaten when she tried to move off, but some public worker or something finally twigged and they got him.
As I said I don`t remember the details 100%, but in Japan they cannot charge you with all the offenses for some reason, so they charge you with the worst of those you commit. He ended up being charged with theft I believe, as he stole something....clothes or something for the girl, and got a total of something like 9 years in jail.
Forget the enslavery, beatings and repeated rapes....he got less time in jail that she had chained to his bed.

Will he at least get beat and raped in jail in Japan?
